Terms of use

1. These terms

Pensar is an app for learning Spanish, made by Shirish Kadam in Valencia, Spain ("we"). By using Pensar you agree to these terms and to our privacy policy. If you don't agree, please don't use the app.

2. A free service

Pensar costs nothing and has no in-app purchases or ads. Points you earn and items for Paco have no money value and can't be exchanged.

To keep it free for everyone, Paco can write a limited amount for each account per day. We may change, add or remove features, and we may stop the service. If we ever plan to charge for anything, we'll say so clearly first.

3. Your account

Pensar starts with an anonymous account on your device. You can save it with Apple or Google to keep your progress on another device. One account per person, please. Keep your Apple or Google account secure, since it's how you get back into Pensar.

4. AI can be wrong

Paco's lessons, feedback, stories, word meanings, audio and journal readings are written by AI (Google's Gemini models). They are usually right, and sometimes they aren't: a meaning can be off, a phrase can sound unnatural, or a correction can miss.

• Pensar is a learning aid, not a professional translation or interpreting service. Don't rely on it for medical, legal, financial or safety matters, or for official documents.
• Paco isn't a counselor. If a journal page suggests you're having a hard time, Paco may point you to a helpline. If you're in danger, contact your local emergency services.

5. What you write, and your journal

Your sentences, answers, journal pages and recordings stay yours. You let us store and process them only to run Pensar for you, including sending them to the AI providers our privacy policy lists.

Your journal is private: no other learner can see it, and we never publish it. Please don't put other people's private information in it.

The app itself, Paco, and the lessons, stories, audio and designs we make are ours or our licensors'. Use them for your own learning.

6. Use it fairly

Please don't:

• Use scripts, bots or modified apps, or try to get around the daily limits or security checks.
• Copy, scrape or resell Pensar's content, or reverse-engineer the app or its server, except where the law allows it.
• Use Pensar to create content that is illegal, hateful, sexually explicit or meant to harm someone.
• Disrupt the service or anyone else's use of it.

We may suspend or delete an account that breaks these rules, and we'll tell you why when we can.

7. Leaving

You can stop using Pensar at any time. To remove everything, go to You › Settings › Delete account, or email us. The privacy policy explains what that removes.

8. No warranty, limited liability

Pensar is provided "as is", without warranties of any kind. We don't promise it will be available without interruption, free of errors, or that it will make you fluent.

As far as the law allows, we aren't liable for indirect or consequential losses arising from your use of Pensar. Nothing in these terms limits liability that can't be limited by law, or takes away rights you have as a consumer.

9. The App Store

Your license to use the app is governed by Apple's Standard End User License Agreement, together with these terms. We, not Apple, are responsible for Pensar and its support.

10. Changes

We may update these terms. We'll change the date at the top, and for changes that matter we'll tell you in the app first. Using Pensar after a change means you accept the new terms.

11. Governing law

These terms are governed by the laws of Spain. Disputes that can't be settled informally go to the courts of Valencia, Spain. If you're a consumer in the EU, you also keep the protection of your own country's mandatory laws and can bring a claim in your local courts.

Before going to court, please write to us. We'll reply within 14 business days and try to put it right.
